Terms of Service

1. Agreement to Terms

By accessing or using CronBeacon (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

3. Description of Service

CronBeacon is a heartbeat monitoring service for cron jobs and scheduled tasks. You configure monitors with expected schedules, and we alert you when those monitors miss their expected check-ins. The Service is provided “as is” without guarantees of uptime or availability, though we strive for high reliability.

CronBeacon is a monitoring tool, not a guarantee of system uptime or job execution. We are not liable for any damages resulting from undetected cron job failures, delayed alerts, or service interruptions. You remain responsible for the correct operation of your own systems and jobs.

4. Technical Requirements

To use the Service you need: a modern web browser with JavaScript enabled (for the dashboard), an internet connection, and the ability to make outbound HTTPS requests from your infrastructure (for sending check-ins). We do not support clients operating over insecure HTTP. No additional software installation is required to use the monitoring service.

5. Prohibited Content and Conduct

You agree not to use the Service to transmit, store, or process any content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable. You also agree not to use the Service to violate any applicable laws or regulations, send excessive automated requests designed to overwhelm our infrastructure, attempt to gain unauthorized access to our systems or other users' data, interfere with or disrupt the Service, monitor systems, servers, or infrastructure that you do not own or have authorization to monitor, reverse-engineer, decompile, or attempt to extract the source code of the Service, share your account credentials with third parties, or resell or redistribute access to the Service without our written authorization.

6. Payment Processing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. By making a purchase, you also agree to Paddle's Terms of Service and Privacy Policy available at paddle.com.

7. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials, all activity that occurs under your account, and notifying us immediately of any unauthorized use.

8. Pricing and Payment

The Service offers subscription plans billed monthly or annually in advance. Prices are displayed in USD. Payments are processed securely by Paddle. Subscriptions renew automatically unless cancelled. You may cancel at any time; access continues until the end of the current billing period. We may change prices with 30 days' notice.

9. Refund Policy

All purchases are final. See our Refund Policy at cronbeacon.dev/refund for details, including information about the EU statutory withdrawal right.

10. Right of Withdrawal (EU Consumers)

If you are an EU consumer, you have the statutory right to withdraw from this contract within 14 days of purchase without giving any reason.

However, CronBeacon is a digital service that can begin immediately upon purchase. During the checkout process, you will be presented with an explicit consent request and asked to confirm that: (1) you request that the Service begins immediately upon purchase; and (2) you acknowledge that you will lose your right of withdrawal once the Service has been fully performed.

If you provide that consent and the Service commences, your right of withdrawal lapses. If you do not provide that consent, the Service will not begin until the 14-day withdrawal period expires.

11. Complaint Procedure

To submit a complaint, contact us at contact@cronbeacon.dev with a description of your issue and your account email. We will respond within 14 business days.

12. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability and will provide reasonable notice when possible. We are not liable for any losses due to service interruptions.

13. Data and Privacy

Your use of the Service is governed by our Privacy Policy at cronbeacon.dev/privacy. You retain ownership of your data. We claim no intellectual property rights over data you submit to the Service. You may export your monitor configurations and check-in history at any time in a standard machine-readable format (JSON). In accordance with the EU Data Act, you have the right to receive your data and to switch to an alternative service provider.

14. Intellectual Property

The Service, including its design, features, and content, is owned by CronBeacon and protected by copyright and other intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

15. Limitation of Liability

To the maximum extent permitted by law, CronBeacon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability for damages caused by willful misconduct or gross negligence (wina umyślna lub rażące niedbalstwo) under Polish law.

16. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

17. Termination

You may terminate your account at any time from your account settings. We may suspend or terminate your account if you: (a) violate these Terms, (b) fail to pay for your subscription, (c) engage in activity that is illegal or harmful to other users or to CronBeacon's infrastructure, or (d) upon 30 days' written notice for any reason. Upon termination, your right to use the Service ceases immediately. We will retain your data for a 30-day grace period, during which you may request a data export. After the grace period, your data will be permanently deleted.

18. Changes to Terms

We may modify these terms at any time. We will notify you of material changes by email at least 30 days before they take effect. If you do not agree with the updated terms, you may cancel your account before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the new terms.

19. Governing Law

These terms are governed by Polish law and the laws of the European Union. Disputes shall be resolved in Polish courts, without prejudice to mandatory consumer protection rights applicable in your EU country of residence.

20. Consumer Protection

If you are a consumer in the European Economic Area, nothing in these Terms limits your rights under Directive 2011/83/EU, the Polish Consumer Rights Act, or other mandatory consumer protection laws of your country of residence. In the event of a conflict between these Terms and mandatory consumer protection law, the mandatory law prevails.

Since 1 January 2021, Polish sole proprietors (jednoosobowa działalność gospodarcza) who enter into contracts outside the scope of their professional activity are entitled to consumer-like protections under Polish law, including the right of withdrawal and protection against abusive clauses.
